tonight, we have breaking news. a star 49er player accused of sexual assault. what we've learned about the investigation into michael crabtree. good evening. i'm ken bastida. >> and i'm elizabeth cook. cbs 5 sports reporter kim coyle is here with us. she's interviewed crabtree dozens of times and was there when he got drafted. but first, juliette goodrich is at the hall of justice in san francisco with what police are saying tonight. >> reporter: tonight, san francisco police are investigating this sexual assault allegation involving 49ers' wide receiver michael crabtree. as of tonight, amid this investigation, cbs 5 has learned he is in atlanta with his team. san francisco police say the alleged sexual assault involving 49ers' michael crabtree occurred in a san francisco hotel room last sunday morning after the 49ers play-off victory over the green bay packers.

today, crabtree was practicing with the team in santa clara. our cameras caught him literally running late to board the team bus as it was en route to the airport and then on to atlanta. in a news release, the san francisco police department said, quote, michael crabtree has been interviewed with his lawyer present and has cooperated in this investigation. michael crabtree has not been detained or arrested and has agreed to make himself available to investigators in the future. the 49ers say they are aware of the allegations against crabtree and say they take such matters very seriously. the team says they have no further comment at this point, as the legal process is ongoing. tonight, many 49ers' sports fans say no one should rush to judgment until the investigation is complete. >> i don't -- i think she's lying. why would you -- why would he do that? he comes to san francisco and he can get whatever he wants.

he's a hero here. >> it's definitely a sad situation. but hopefully michael will be able to play in the game this sunday. he's a phenomenal player and we really want our 49ers to win! >> reporter: so here's where things stand tonight. the sexual assault allegation is being investigated by the special victims unit and then it will be presented to the d.a.'s office. liz, tonight, the 49ers' wide receiver is in atlanta and as of tonight, he is set to play in this sunday's championship game. >> all right, juliette. thank you. kim coyle joins us now. kim, how is this going to impact the team in sunday's game. >> reporter: he's the second- best receiver in the nfl. when colin kaepernick came, he became one of his favorite targets. so during the regular season, michael crabtree had the most yards by a 49ers' wide receiver since terrell owens in 2002. the investigation comes on the heels of one of the best games of crabtree's career. the 25-year-old caught nine passes for 119 yards and two touchdowns in saturday's win

over the packers. but the former first-round pick has always been a bit of a mystery. he wears his trademark sunglasses during press conferences and rarely speaks with the media during the week. crabtree came in the league with the representation as a bit of a diva. as for the team, with no media availability until after the game, this likely won't be much of a distraction, as they put all their focus on trying to get back to the super bowl. and i've been around him a lot. squeaky clean. the man designs his own shoes and clothing. so it's really disappointing to hear this news tonight. >> it's important, though, in any kind of professional sports. i mean, this could have an impact on his legacy, i think, whether or not what happens on sunday. >> it could, depending on the outcome. it could affect his future career in the nfl as well. >> kim, thank you for that. news of the investigation came out as the team was on a

chartered plane. you can see michael crabtree with them. the team landed in atlanta a few hours ago, then they took a bus to their hotel. tonight's developments are something else that a young quarterback has to try to ignore come kickoff time. but mark sayre says that colin kaepernick says that he is ready and he is focused for sunday's game. and mark, colin revealed a little bit about himself today as well, didn't he? >> reporter: indeed he did. calling kaepernick a man of few words, doesn't talk to the media a whole lot. today here at the practice facility, he revealed a little bit about his love of football and also his love of facts proved. he may be the hottest player in the nfl but colin kaepernick certainly doesn't talk that way. how does he see the trip to atlanta for the nfc championship game? >> this is 100% a business trip. this is what we worked for all season. >> reporter: how about reaching

his childhood dream of playing for the 49ers and going to the conference championship game after just two months as a starting quarterback? >> i don't have time to stop and think right now. too much work to be done. >> reporter: and if the stress and mistakes of sunday's game are weighing on kaepernick, he certainly doesn't show it. he appeared in a postconference news conference and talked about his big love of fast food. >> for me, if i work out enough, i feel like i'm going to be all right. >> reporter: he says he used to really like big macs. >> not so much mcdonald's anymore. >> reporter: kaepernick was previously a baseball player drafted by the chicago cubs in 2009. but he passed on that offer to continue his football career at nevada and he says he's now doing what he loves. >> there's just a passion about football that no other sport can give you. i mean, in football, if one player messes up on offense, the whole play is done.

>> reporter: now, kaepernick not only hit the cover of sports illustrated this week, he also is the top-selling nfl player in terms of official merchandise and the 49ers are the top-selling team in terms of official merchandise, at least the last weekend. we'll see how they do over the weekend. >> unbelievable game coming up. all right. mark sayre in santa clara. thank you, mark. notre dame linebacker manti te'o has talked for the first time since the whole girlfriend hoax scandal broke. tonight he told espn in an off- camera interview he was never involved in creating the hoax. he said, quote, when they hear the facts, they'll know. there is no way i could be a part of this. he insists he was the victim of a cruel joke. manti te'o also tells espn that the girl has apologized for the girlfriend hoax. and lance armstrong has

been spilling the dirty truth. he was more emotional in his two-part confession to oprah winfrey. >> reporter: lance armstrong apologized to his fans. and all those who believed in him. in part two of his interview with oprah winfrey. the disgraced cyclist spoke directly to those who wore his livestrong bracelets and stood by him during his decade of lying about doping. >> i understand your anger, your sense of betrayal. >> uh-huh. >> you supported me forever, through all of this, and you believed. and i lied to you. and i'm sorry. >> reporter: armstrong said his first wife, christin, new about the use of performance- enhancing drugs. he also said his lowest moment wasn't his being stripped of his cycling titles. it was when his own livestrong foundation asked him to step away. >> it was the best thing for

the organization. but it hurt like hell. >> reporter: the disgraced cyclist got emotional when talking about how one of his children had been defending him to kids in school. >> i told luke, i said -- i said don't defend me anymore. >> reporter: armstrong's confession may eventually help him to lift the lifetime ban in competitive sports. before then, armstrong could likely face several lawsuits that could wipe out his estimated net worth of $100 million. he concedes he has an uphill battle to get back into sports. the u.s. anti-doping agency says in order to consider it, he needs to confess under oath, not to oprah. a berkeley couple who has been missing since christmas

eve was found dead. the bodies of 52-year-old camile and her boyfriend were discovered in shasta county. authorities believe they were out hiking when bad weather set in. dramatic video near tahoe shows a skier triggering an avalanche and getting buried. and waiting to be rescued. >> watch him, watch him, watch him! watch him! >> the video was taken from the helmet cam of the main rescuer. it takes him a good two minutes to start done the slope after exchanging gear with another skier. his friend was free a few minutes later. skiers admit they made mistakes, including being ill- equipped and underprepared for such a rescue. >> amazing how fast that happens. coming up, meet america's newest enemy. they call him the marlborough

and prayed. algeria news service says a dozen hostages were killed. roughly 30 foreigners are still unaccounted for. the suspected mastermind of the hostage crisis is a rebel leader with ties to al-qaeda. some call him the marlborough man. others just call him one eye. cbs reporter david martin says no matter what his alias, the u.s. calls him our newest enemy. >> reporter: maktar, aka one eye, because he lost an eye fighting in afghanistan, aka the marlborough man because he made a living smuggling cigarettes. no westerner knows him better than robert fowler, who was his hostage in 2008. >> it was absolutely no doubt who was the boss. he wasn't a flashy guy. but he was rather soft-spoken. but as soon as he began speaking, everybody would listen. >> reporter: though he has been known to intelligence agencies

and cbs 5 reporter joe vazquez shows us, it got ugly outside court today. >> [ bleep ] [ bleep ] >> reporter: outside the santa clara county hall of justice, emotions boil over as a confrontation between two families breaks out into a fight. the cops quickly surround the woman in the black t-shirt and slap the cuffs on her. family members say she is the 18-year-old daughter of christopher soriano, a san jose man who was shot to death on new year's eve. the folks in white t-shirts are family and friends of luis hernandez, a handyman who is behind bars for killing soriano. he is charged with murder. his family believes he was simply trying to make a citizen's arrest of a man he believed was burglarizing a car and shouldn't be in jail. >> we request them to let him

go and to set a bail that this family can put forth. the man had no right to kill my son! >> reporter: the people in black t-shirts disagree. they are family and friends of soriano, the man who was killed. >> he had no legal gun, for god sakes. and he kills a man, a father of five children. they took my son away from me! how can they say he's a hero? >> reporter: as it ended, the two families left the courthouse together and that's when the war of words led to the fight outside. joe vazquez, cbs 5. >> and charges were filed in that fight. the d.a.'s office released a statement about hernandez, saying he has had no legal excuse or justification for using deadly force on an unarmed man. say good-bye to two buck
